Terms of Service

These terms are an agreement between you and Jarrett Ferris, doing business as JDF Builds (“we”, “us”), about your use of the FloraPulse app and related services. By creating an account or using the app you agree to them.

Using FloraPulse

You must be at least 13 years old, and old enough to form a binding contract where you live or have a parent or guardian’s permission. Keep your sign-in details secure; you are responsible for activity on your account. Use the app lawfully and do not attempt to break, overload, reverse engineer, or misuse it or its AI features.

Your content

You keep ownership of the plants, notes and photos you add. You give us a limited licence to store, process and display them only as needed to run the app for you, including sending photos you choose for AI scans to our AI provider. Do not upload content you do not have the right to share or that is unlawful.

Plant care information is guidance only

FloraPulse reminders, care schedules and AI diagnoses are general suggestions. Plants vary, and AI results can be wrong. Do not rely on the app to decide whether a plant is safe to eat or safe around children or pets. Always check with a qualified source before consuming anything you grow or identify, and take pets and children’s safety seriously. We are not responsible for loss of plants or harm resulting from care decisions.

Subscriptions and payments

Pro is a paid subscription. Prices, billing, renewal, cancellation and limits are described in our Subscription terms, and refunds in our Refund policy. Those documents are part of these terms.

Changes to the service

We may update, add or remove features, including free-tier limits, with reasonable notice where practical. We may suspend or end accounts that break these terms.

Ending your account

You can delete your account at any time in the app or by following our account deletion page.

Disclaimers

The app is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not promise the service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, plants, profits or goodwill. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim, or US $50. Some places do not allow these limits, so they may not apply to you.

Governing law

These terms are governed by the laws of Washington, United States, without regard to conflict of law rules. Disputes will be resolved in the courts of King County, Washington unless the law requires otherwise.

Changes to these terms

We may update these terms. If changes are material we will give notice, for example in the app. Continuing to use FloraPulse after the effective date means you accept the new terms.
